1. Introduction
These Terms and Conditions ("Terms") govern your use of our online will writing service ("Service") provided by [Your Company Name Limited], a company registered in England and Wales with company number [Insert Number], whose registered office is at [Insert Address] ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. We are not a law firm, and the Service does not constitute legal advice. We provide a self-service tool to generate basic will documents based on information you supply. You are responsible for ensuring the document meets your needs and complies with applicable laws. These Terms apply to all users of the Service, who must be at least 18 years old and resident in England, Wales, Scotland, or Northern Ireland (as applicable; note that laws differ across UK jurisdictions).
2. Our Service
-
The Service allows you to create a basic online will ("Document") by answering questions via our website/app.
-
Once completed and paid for, we will generate and email you the Document in editable format (e.g., PDF).
-
You are solely responsible for reviewing, signing, witnessing, and storing the Document correctly. We do not verify your identity, mental capacity, or the accuracy of your information.
-
The Service is for personal use only and not for commercial purposes.
3. Your Obligations
-
You must provide accurate, complete, and truthful information when using the Service.
-
You confirm you have the mental capacity to make a will and are not under undue influence.
-
You agree to use the Document only in the relevant UK jurisdiction and to seek independent legal/tax advice if your situation is complex (e.g., international assets, blended families, or high-value estates).
-
You must not misuse the Service, including by reverse-engineering our software or sharing login credentials.
4. Pricing and Payment
-
The price for the Service is £49 for a Single Will, £79 for a Mirror Will (inclusive of VAT). Prices are displayed on our website before purchase.
-
Payment is processed securely via Stripe. Full payment is required upfront.
-
No refunds are provided after the Document is generated, except as required by law.
5. Intellectual Property
-
All rights in the Service, including software, templates, and branding, remain our property. You are granted a non-exclusive, non-transferable licence to use the generated Document for personal purposes only.
6. Cancellation and Refunds
-
You may cancel before payment is processed. After generation, no refunds unless the Service is faulty (in which case, we may re-generate or refund at our discretion).
-
We reserve the right to cancel your order if we suspect fraud or ineligibility.
7. Limitation of Liability
-
Death or personal injury caused by our negligence;
-
Fraud or fraudulent misrepresentation; or
-
Any other liability that cannot be excluded or limited by law (e.g., your statutory consumer rights under the Consumer Rights Act 2015).
b. We are not liable for:
-
Any indirect, consequential, or special losses (e.g., loss of profits, business interruption, or emotional distress);
-
Losses arising from your failure to follow instructions, provide accurate information, or seek professional advice;
-
Verification of your identity, age, capacity, or the validity of the Document (e.g., testamentary capacity, undue influence, or third-party claims);
-
Changes in law, tax rules, or your personal circumstances after Document generation;
-
Any tax liabilities or inheritance tax implications; or
-
Factors outside our control (e.g., third-party delays in email delivery).
c. Our maximum aggregate liability to you for all claims arising from or in connection with these Terms or the Service (whether in contract, tort, breach of statutory duty, or otherwise) shall be limited to 100% of the amount you paid for the Service (e.g., the purchase price of the Document). This cap applies per claim and in total.
d. Each of the above sub-clauses is separate and operates independently. If any are found unenforceable, the remaining limits still apply. Nothing in these Terms affects your statutory rights as a consumer.
